Introduction to Principles of Law Enforcement by Peace Officers

The purpose of this SLP is to equip students to be capable of understanding the relevant sections and regulations contained in the criminal procedure legislation pertaining to peace officers. The SLP will enable the student to apply the applicable legislation by enforcing the provisions of the legislation, teaching the public and leading by example.

Law Enforcement by Peace Officers

 

This SLP will prepare students to enforce municipal by-laws and legislation. It is aimed at the training of any official who is responsible for the implementation and enforcement of by-laws or legislation and for whom appointment as a peace officer in terms of section 334 of the criminal procedure Act, 51 of 1977 is required.

Law Enforcement by Peace Officers for Environmental Health Practitioners (EHP’s)

This SLP aims to provide Environmental Health Practitioners (EHPs) with the knowledge required to promote and enforce health legislation. It equips them with the knowledge to undertake inspections of premises and to stop or prevent damaging or harmful activities, investigate the possible impacts of the activities and to ensure compliance with notices and implementation of corrective or alleviating measures where necessary.

Law Enforcement by Peace Officers for Liquor Authorities

This short learning programme aims to provide the knowledge required for appointment as peace officers to persons who already comply with the other legislative prerequisites (e.g. a certain scholastic level, a drivers license, a clean record with regard to previous criminal offences) in order to enable them to enforce the legislation applicable to their entity or organisation.

Principles of Advanced Law Enforcement by Peace Officers

The main purpose of this SLP is:

• To provide theoretical knowledge required for professional staff of municipalities such as Town Planners, Building Control Officers, Fire Chiefs and Environmental Managers

• To ensure compliance with the National, Provincial and Municipal legislation applicable to their functions as well as the implementation of administrative, civil and criminal enforcement measures available.

Code of Conduct: Procedures for Disciplinary Hearings & Investigations

The purpose of this 1 or 2 -day short learning programme is to establish a uniform and common procedure for investigations into the breach of the Code of Conduct for Councillors.

Combined Councillors & Officials

• Kindly note a more detailed outline for each of the modules can be provided on request from the project office.

• The Specialist Programme comprises 10 modules (see next page) however each can be run as a separate stand-alone short learning programme. Delegates completing these 10 modules will receive credits on to the Municipal Management Development Diploma Programme (MDP) offered by the Nelson Mandela University’s Business School, should they wish to further their studies.

The purpose of this 3-day short learning programme it to provide municipal officials and councillors with:

1. An understanding of the status, objectives and place of local government within the Constitutional framework, the extent of its powers and functions and its relationship with national and provincial government;

2. An overview of the Municipal Finance Management Act, 2003 (Act No. 56 of 2003) (MFMA) with specific reference to:

  • Sound financial governance;
  • Financial management roles and responsibilities as legislated in the MFMA; and
  • Specific roles with regard to certain fiscal and financial processes.

3. A legal overview of supply chain management within a prescribed regulatory framework;

4. The necessary skills to detect and prevent corruption and maladministration in public organisations.

The purpose of this 1-day SLP is to capacitate councillors with a comprehensive understanding of their roles and responsibilities including any legal implications regarding the appointment and discipline of officials, as commissioners of oaths and in section 62 appeals.
