Short Learning Programmes 2023

Introduction to Principles of Law Enforcement by Peace Officers

The purpose of this SLP is to equip students to be capable of understanding the relevant sections and regulations contained in the criminal procedure legislation pertaining to peace officers. The SLP will enable the student to apply the applicable legislation by enforcing the provisions of the legislation, teaching the public and leading by example.

Law Enforcement by Peace Officers

This SLP will prepare students to enforce municipal by-laws and legislation. It is aimed at the training of any official who is responsible for the implementation and enforcement of by-laws or legislation and for whom appointment as a peace officer in terms of section 334 of the criminal procedure Act, 51 of 1977 is required.

Law Enforcement by Peace Officers for Environmental Health Practitioners (EHP’s)

This SLP aims to provide Environmental Health Practitioners (EHPs) with the knowledge required to promote and enforce health legislation. It equips them with the knowledge to undertake inspections of premises and to stop or prevent damaging or harmful activities, investigate the possible impacts of the activities and to ensure compliance with notices and implementation of corrective or alleviating measures where necessary.

Law Enforcement by Peace Officers for Liquor Authorities

This short learning programme aims to provide the knowledge required for appointment as peace officers to persons who already comply with the other legislative prerequisites (e.g. a certain scholastic level, a drivers license, a clean record with regard to previous criminal offences) in order to enable them to enforce the legislation applicable to their entity or organisation.

Principles of Advanced Law Enforcement by Peace Officers

The main purpose of this SLP is:

• To provide theoretical knowledge required for professional staff of municipalities such as Town Planners, Building Control Officers, Fire Chiefs and Environmental Managers

• To ensure compliance with the National, Provincial and Municipal legislation applicable to their functions as well as the implementation of administrative, civil and criminal enforcement measures available.

Councillors Programme

Code of Conduct: Procedures for Disciplinary Hearings & Investigations

The purpose of this 1 or 2 -day short learning programme is to establish a uniform and common procedure for investigations into the breach of the Code of Conduct for Councillors.

Combined Councillors & Officials

• Kindly note a more detailed outline for each of the modules can be provided on request from the project office.

• The Specialist Programme comprises 10 modules (see next page) however each can be run as a separate stand-alone short learning programme. Delegates completing these 10 modules will receive credits on to the Municipal Management Development Diploma Programme (MDP) offered by the Nelson Mandela University’s Business School, should they wish to further their studies.

Communication & Public Participation

The purpose of this 1-day short learning programme is to capacitate delegates with a comprehensive understanding of the importance of communication and public participation within the context of local government in South Africa. Please note that this new 1-day SLP can be split into 2 x half-day contact sessions as follows:

• Part A: Communication

• Part B: Public Participation

Delegation of Powers in Local Government

This 1-day short learning programme offers councillors a brief overview of the requirements for valid and lawful delegation and its operation in the municipal environment and explains the principle of legality with regard to the exercise of public power in order to ensure that municipalities comply with the law.

Introduction to Local Government Law

The purpose of this 3-day short learning programme it to provide municipal officials and councillors with:

1. An understanding of the status, objectives and place of local government within the Constitutional framework, the extent of its powers and functions and its relationship with national and provincial government;

2. An overview of the Municipal Finance Management Act, 2003 (Act No. 56 of 2003) (MFMA) with specific reference to:

Sound financial governance;
Financial management roles and responsibilities as legislated in the MFMA; and
Specific roles with regard to certain fiscal and financial processes.

3. A legal overview of supply chain management within a prescribed regulatory framework;

4. The necessary skills to detect and prevent corruption and maladministration in public organisations.

Role of Councillors in the Appointment & Discipline of Officials, section 62 appeals & as Commissioners of Oaths

The purpose of this 1-day SLP is to capacitate councillors with a comprehensive understanding of their roles and responsibilities including any legal implications regarding the appointment and discipline of officials, as commissioners of oaths and in section 62 appeals. Please note that this new 1-day SLP can be split into 2 x half-day contact sessions as follows:

• Part A: Role of Councillors in the Appointment and Discipline of Officials (half-day)

• Part B: Role of Councillors in S62 Appeals and as Commissioners of Oaths (half-day)

Oversight in Local Government: Guidelines for Councillors (including Municipal Public Accounting Committees)

This 1-day short learning programme is designed to provide councillors with an overview of the various oversight duties within the municipal environment, in order to enable the council to govern without interfering with the administration.

Rules of Procedure: Conduct at Meetings of a Municipal Council

To train councillors on the legal rules pertaining to the conduct of meetings, the procedural requirements and the consequences of non-compliance.

The Constitutional Mandate of Local Government

The purpose of this short learning programme is to enable councillors to understand the status, objectives and place of local government within the constitutional framework, the extent of its powers and functions and its relationships with national and provincial government.

The Law Governing Decisions and Decision-making in Local Government

This 1-day short learning programme is designed to give councillors an overview of the legal requirements for taking valid and lawful decisions in order to minimise the risk of legal action being taken against the municipality.

The Legal Rules Governing the Roles & Responsibilities of Political Structures, Political Office Bearers & the Municipal Manager

This 1-day short learning programme is designed to clarify the roles and responsibilities of the most important role-players in the municipality, their lines of accountability and reporting, interaction with each other and how to resolve disputes.

The Role of the Councillor in Supply Chain Management

The 1-day short learning programme is designed to offer councillors a legal overview of supply chain management in local government in order to enable them to act within the limits of the laws applicable to them.

The Role of the Speaker and Mayor in Local Government

The purpose of this 1-day short learning programme is to provide an overview for councillors of the legal role of the speaker as the chairperson and enforcer of the Code of Conduct for councillors and of the role of the Executive Mayor in an Executive Mayoral system.

The Role & Responsibilities of Municipal Councillors in terms of the MFM

To provide the newly elected municipal councillors with a high level legal overview of the Municipal Finance Management Act, 2003 (Act No. 56 of 2003) (MFMA) and to inform councillors of their:

• Roles and responsibilities in Terms of the MFMA; and

• Specific roles with regard to fiscal and financial processes as set out in the MFMA.
